DMCA & Intellectual-Property Policy

Plag Detect respects the intellectual-property rights of others. If you believe that material on the Service infringes a copyright you own or control, please send us a notice that complies with the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512(c)(3).

1. How to Send a DMCA Notice

Email your notice to support@plagdetect.org with the subject line “DMCA Notice” and include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing and a URL or other location sufficient to enable us to find it.
  4. Your contact information — address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner of the right that is allegedly infringed.

2. Counter-Notice

If material you posted was removed and you believe the removal was the result of a mistake or misidentification, you may submit a counter-notice to the same email address. The counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed by mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or, if your address is outside the United States, of any judicial district in which Plag Detect may be found.
  5. A statement that you will accept service of process from the person who filed the original DMCA notice or that person’s agent.

3. Repeat Infringers

Accounts that are the subject of repeated valid DMCA notices will be terminated.

4. False Claims

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. Please consider this before submitting a notice or counter-notice.
